THE LEAD TO SALE TRACKER™ TERMS OF SERVICE IMPORTANT-READ CAREFULLY! This CJJB Internet Works Terms of Service ("TOS") is a legal agreement between you (individual or single entity) and CJJB Internet Works ., for the CJJB Internet Works ., software service accompanying this TOS, which includes THE LEAD TO SALE TRACKER™ computer software service and associated media and printed materials, and may include "online" or electronic documentation (herein referred to "Software Service" or "Software"). By exercising your right to use the Software Service, you agree to the terms of this TOS. If you do not agree to the terms of this TOS, your rights for use will be revoked. SOFTWARE SERVICE LICENSE: The Software Service is protected by copyright laws and international copyright treaties as well as other intellectual property laws and treaties. The Software is delivered as a service and is licensed, not sold. RIGHTS OF SERVICE: CJJB Internet Works grants you a nonexclusive, royalty-free right to use ONE COPY of the Software on ONE Internet Domain. Your ONE COPY may be used for only ONE Affiliate Program regardless of the number of users/virtual websites hosted on any single Internet Domain. COPYRIGHT: All title and copyrights in and to the Software (including but not limited to any image, photographs, animations, video, audio, music, text and "applets", incorporated into the Software) are owned by CJJB Internet Works or its suppliers. The Software Service is protected by copyright laws and international treaty provisions. Therefore, you must treat the Software like any other copyrighted material. OTHER RESTRICTIONS: This TOS is your proof of license to exercise the rights granted herein and must be retained by you. You may not reverse engineer, decompile, or disassemble the Software except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. NO SPAM Policy: CJJB Internet Works does not and will not tolerate the sending of unsolicited email messages and will prosecute all offenders to the fullest extent of the law. You must immediately terminate any Affiliate found in violation of this policy. This includes but is not limited to Affiliates that use the email based feature in the Software Service, and Affiliates that use their own email programs/accounts to send unsolicited mailings regarding your Affiliate Program or your products/services. If you do not immediately terminate such Affiliates, CJJB Internet Works reserves the right to do so. You will be found in violation of this policy if you send unsolicited mailings using any portion/feature of the Software/Service including an Affiliate Link, or if you allow your Affiliates to send unsolicited mailings. Violation of this policy is terms for immediate termination and refusal of future use. TECHNICAL SUPPORT: CJJB Internet Works (CJJB) offers free incident-based support to resolve installation issues, product usage, and troubleshooting. CJJB Internet Works will supply technical support via email as it pertains to THE LEAD TO SALE TRACKER™ Software Service. Integration of Products and maintaining the integrity of the integration is the responsibility of the customer/client. Upon receipt of the support request, a CJJB support technician will identify the nature of the reported problem and suggest a proper course of action. This may include a referral to the product documentation, Help Files or Frequently Asked Question (FAQ) lists on the THE LEAD TO SALE TRACKER™ web site. If the problem is identified as being either a third party module issue or an ISP/IHP issue, CJJB Support will refer the merchant to the appropriate source for a solution. Support for problems encountered in the normal operation of the product will be provided until: · It is determined that the merchant is attempting to use the software in an improper environment. The merchant will be referred to or given information about environment requirements and/or advised to contact the party responsible for their operating environment for support. · It is determined that the integration of the software with which the merchant is experiencing the problem is damaged or modified. The merchant will be referred to or given information about reintegrating the software and/or advised to contact the party responsible for the modifications for support. · It is determined that the merchant is attempting to use the software to do something it is not designed to do. The merchant will be referred to or given information about the software's proper use. DATA STORAGE: The software and data for THE LEAD TO SALE TRACKER™ Software will be hosted on CJJB Internet Works servers. CJJB Internet Works does not warrant that your use of the Product will be uninterrupted or that the operation of the Product will be error-free or secure. In addition, the security mechanisms implemented by CJJB Internet Works have inherent limitations, and you must determine that the Service sufficiently meets your requirements. While CJJB Internet Works shall make every reasonable effort to protect and backup data for Licensee on a regular basis, CJJB Internet Works .is not responsible for Customer's/Client's data residing on CJJB's servers. Customer/client is responsible for making and keeping current copies of Members and their related information. Customer/client is responsible for all use of customer's/client's account and confidentiality of customer's/client's password and information. The minimum monthly hosting charge is $49 per license for the Small Business Version, the Enterprise Version, is $5000 per month. All monthly hosting fees are billed in advance for the minimum amount due. This monthly fee per license represents the anticipated cost per month, per customer/client for bandwidth and server resources. In the future if CJJB Internet Works finds that the bandwidth and server costs increase as a result of "excessive" or "high" activity, CJJB Internet Works reserves the right to increase monthly hosting charges accordingly. The minimum monthly charges for the server costs will be billed according to the following schedule: · Small Business Version: Includes an Affiliate Module for 500 affiliates and 1 Affiliate Manager. A Sales Module with access for 1 Sales Manager, 5 Sales Assistants and 50 Sales Team Members. Set Up Fee is $299 for online applicants and $499 for assistance by the support team. Additional modules are available at $250 set up and an additional $49 hosting fee. · Enterprise Version: Includes an Affiliate Module for 500 affiliates and 1 Affiliate Manager. A Sales Module with access for 1 Sales Manager, 5 Sales Assistants and 50 Sales Team Members. An Accounting Module with access for 1 Accounting Manager, 5 Accounting Assistants and 50 Accounting Team Members. An Operations Module with access for 1 Operations Manager, 5 Operations Assistants and 50 Operations Team Members and 4 additional complete Modules with customized features and actions. Hosting Fees: $5000 per month CJJB reserves the right to change the Monthly Hosting Charges at any time. OTHER TERMS: CJJB Internet Works reserves the right use your name and/or logo in our promotional material as a client of CJJB. Any individual signing up to become your affiliate will receive a free membership to the www.Affiliate-net.net website and email subscription. CJJB Internet Works reserves the right to place a link to such, of our choosing and design, on affiliates' administration pages. By using this Software Service, you and your affiliates become authorized users and can be disclosed as such. CJJB Internet Works will not share, sell, trade, barter or offer for free your affiliate data to any other individual, company or entity that is not owned solely or in part by CJJB. LIMITED WARRANTY: NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall CJJB Internet Works or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss if business information, or any other pecuniary loss) arising out of the use of or inability to use this CJJB Internet Works product, even if CJJB Internet Works has been advised of the possibility of such damages. US GOVERNMENT RESTRICTED RIGHTS: The Software Service is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) OF THE Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. MISCELLANEOUS: If you acquired this product in the United States, this TOS is governed by the laws of the State of Florida. If this product was acquired outside the United States, local laws may apply. CJJB Internet Works .is not in any way responsible for any damages caused by the use or misuse of this product.
